What is a waiver of subrogation?
A waiver of subrogation usually has to do with workers’ compensation and general liability.
It’s something a client may ask you to sign before you start a job. If your client asks you to sign a waiver of subrogation upfront, that means that you waive your rights of recovery from their insurance company.
Here’s an example.
You are contracting work with a client. You also have subcontractors or employees working for you to help out on the project.
If a waiver of subrogation has been signed and the client somehow causes an injury to your subcontractor or employee, you cannot come back and collect workers’ compensation from the client’s insurance company, even though they played a part in the occurrence.
